Delay in Processing of the Labour Law Amendment Bills

Dear Member,

Members may be aware of the media reports that the National Minimum Wage may not be implemented on 1 May 2018 as scheduled.

 

We have followed up in this regard and have been advised that the Parliamentary Portfolio Committee on Labour has indicated that it will not be in a position to  process all three Bills – the Labour Law Amendment Bill, the Basic Conditions of Employment Bill and the National Minimum Wage Bill in time for the 1 May 2018 implementation.

 

The Committee is taking oral submissions tomorrow, 27 March 2018, and will return early from recess to engage on the Bills. It is anticipated that the process will be concluded by the end of April 2018. There is no indication as to the new implementation date, but it is anticipated that there will be a 2-3 month delay.

 

Please find attached the BUSA submission (previously sent out to members), as well as that made by organized labour (COSATU, FEDUSA, and NACTU), to the Parliamentary Portfolio Committee on Labour.

 

It is significant to note the parties are for the large part supporting the agreements reached.
